Terms of Service — CarHostProtect

These Terms of Service ("Terms") govern your access to and use of the CarHostProtect information network operated by CarHostProtect LLC ("CarHostProtect", "we", "our"). By creating an account, checking the acceptance box at signup, or continuing to use the service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. The service is intended for use by independent car rental hosts and fleet operators in the ordinary course of their rental business.

2. Not a consumer reporting agency

CarHostProtect is not a "consumer reporting agency" as defined by the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et seq., "FCRA") or by any state equivalent consumer credit reporting law. The information available through the service is not a "consumer report" and is not assembled or evaluated for the purposes covered by the FCRA.

Reports on CarHostProtect are firsthand accounts submitted by other members and are provided for informational purposes only. By using the service, you expressly agree that you will not use any information obtained through the service, in whole or in part, as a factor in:

establishing a person's eligibility for credit, insurance, employment, housing, or a government benefit;
any decision covered by the FCRA or a state equivalent; or
any decision to rent — or refuse to rent — a vehicle to any specific person.

You will make your own independent rental decisions using your own criteria and, where applicable, an FCRA-compliant consumer reporting agency.

3. Your responsibility for what you submit

You are solely responsible for the reports, images, documents, and Do Not Rent notes you submit. You represent and warrant that:

Every report you submit is a truthful, firsthand account of an incident you personally experienced or directly witnessed as the rental host.
You obtained any driver identifiers and evidence lawfully in the ordinary course of your rental transaction.
You will not submit content that is defamatory, harassing, discriminatory, or retaliatory, and you will not use the service to intimidate any person.
You will keep information accurate and will promptly correct or withdraw a report if you learn it was mistaken.

4. Prohibited conduct — grounds for termination

The following will result in immediate suspension or permanent termination of your account, forfeiture of any prepaid fees, and where warranted a referral to law enforcement:

Submitting a knowingly false, exaggerated, or fabricated report.
Filing a report to retaliate against a driver for a lawful complaint, chargeback, or protected activity.
Using the service to make rental decisions in a manner that violates federal, state, or local anti-discrimination law.
Using the service as an FCRA "consumer report" (see Section 2).
Scraping, redistributing, or reselling data obtained from the service.
Attempting to identify a reporter or otherwise circumvent our access controls.

5. Dispute and removal process

Any driver who is the subject of a report — whether or not a CarHostProtect member — may submit a dispute at carhostprotect.com/dispute. While a dispute is under review, the report is flagged as disputed and is excluded from the aggregated match signal shown to other members. We may contact the original reporter for substantiation and may remove a report at our discretion if we determine it cannot be reasonably substantiated, was submitted in bad faith, or otherwise violates these Terms.

6. Indemnification

You agree to defend, indemnify, and hold harmless CarHostProtect LLC, its officers, employees, and service providers from and against any claim, demand, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of or related to: (a) any report, image, document, or other content you submitted; (b) your breach of these Terms or any representation you made in them; or (c) your use of any information obtained through the service, including any decision you made — or failed to make — based on that information.

7. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT ANY REPORT REFLECTS A COMPLETE OR ACCURATE HISTORY OF ANY PERSON. We do not independently verify reports. The absence of a match in the network does not mean a driver is safe, and the presence of a match does not establish liability.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARHOSTPROTECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR RENTAL INCOME, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Subscriptions, billing, and cancellation

Subscriptions renew automatically at the interval you selected until you cancel. Cancellations take effect at the end of the current billing period. Fees are non-refundable except where required by law.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the service will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

11. Changes

We may modify these Terms from time to time. Material changes will be posted on this page and, for members, sent by email. Continued use of the service after the effective date constitutes acceptance of the changes.
